Undocumented workers can file claims for unpaid wages without fearing deportation

Working undocumented in Korea and haven’t been paid? Or worse, got injured on the job but the boss threatens to report you to Immigration if you complain?

Stop letting them scare you. Here is the legal truth:

Under Korean Labor Law, your visa status does not change your rights as a worker. The Labor Standards Act protects everyone.

This means you have the exact same right to claim every single KRW of your unpaid wages, overtime pay, and severance pay.

What if you get hurt at work? You are covered by Industrial Accident Compensation Insurance, known as ‘Sanjae(산재 or 산업재해)’.

Your medical bills and lost wages must be covered, and filing a claim will not trigger an automatic deportation. The Ministry of Employment and Labor is there to judge the labor violation, not to hunt for undocumented workers.
